New organic law in Brazil
The law is the n° 10.831 and became effective from the 1st of January of 2011, which means that all exports of organic products must be made to Brazil verified by this new law. This is a recertification process for entry of product to be exported to the neighboring country and that management takes between 30 and 45 days from submission of required documentation.
The law consists of a general rule, a technical and an instruction for agencies. The main aspects of the law are: definition of organic produce, organic system awareness and production, certification requirements, liability and penalties, and special registration procedures of inputs.
Another point to note is that Brazil was based on existing regulations in Argentina and that is why it is closely related to our country works since 1992.
One of the most important features of the regulation of organic agriculture in Brazil is the recognition of the participatory process of conformity assessment, a solidarity system for generating credibility, where the development and verification of standards for organic production are made the effective participation of farmers and consumers.
The Sectorial Chamber of the Productive Chain of Organic Agriculture collaborated on the adaptation of texts of Presidential Decree (sent for signature to the President of Brazil), which regulates Law No. 10,831 created the control mechanisms, monitoring and sanctions and Instructions regulations that complement the legal framework.
